ACC Covenants
Top 6 Rules
1) Don't park on the Roads
2) Don't sled on the Roads in the Winter
3) Have your dog under your direct control
4) Clean-up after Pets
5) Get approval from Architectural board BEFORE in exterior remodeling and/or painting

ALPENTAL COVENANT POLICY 

Covenants are the instrument a community uses to protect property values and to a lesser extent to define an attractive living environment agreed to by the majority of owners.  

Alpental Covenants have been followed historically by the large majority of property owners. However there are some, whether by lack of knowledge or willful intent, who break the rules, disobey the covenants or generally disrespect others. Those individuals, whether homeowners or renters are subject to financial discipline. 

To address the former, the following steps are to be taken:

1. ACC attempts to engage the property owner regarding the issue, violation or situation.

2. ACC utilizes the published Fine Schedule as desired. *Fines may be assessed upon the homeowner per violation with no maximum number of times or amounts. Fine values are subject to the Board of Trustees and determined based on the severity of the violation and attention of the homeowner to the matter. 

FINE SCHEDULE

Parking Violations - No warnings! This is a big deal and all aware of its importance 

1. On-Street Parking - Winter $250.00 minimum/violation/day  

* No warnings are to be issued by the ACC. Base fine amount is automatic and billed directly to the homeowner. Beyond the base fine amount the homeowner is also subject to extra plow time at $150/Hour for return work required due to the parking violation. 

2. On-Street Parking - Summer $150.00/violation/day  

*ACC reserves the right to tow the vehicle. Vehicle towing fees are the responsibility of the car owner and the ACC will not be held responsible for any damage from the towing or storage of the vehicle while impounded. A towed vehicle does not exempt the homeowner from the base fine. 

Pet Violations - (1) warning provided to homeowner/renter or both prior to fine(s) 

1. Nusance Violation - Barking $100.00 minimum/violation  

Base fine amount is automatic and billed directly to the homeowner. 

2. Roaming Voilation - Unleasehed $100.00 minimum/violation  

Base fine amount is automatic and billed directly to the homeowner.

3. Pet Waste Voilation $100.00 minimum/violation  

Base fine amount is automatic and billed directly to the homeowner.

Noise Violations

1. Excessive Noise $250.00 minimum/violation  

* No warnings are to be issued by the ACC. Base fine amount is automatic and billed directly to the homeowner.

Speed Violations - (1) warning provided to homeowner/renter or both prior to fine(s)

1. Excessive Speed $100.00 minimum/violation  

Base fine amount is automatic and billed directly to the homeowner. Speeds should be kept at less than 20 MPH on all Community Roads. 

Architectural Violations

1. Per Violation $200.00 minimum  

* The ACC and/or the Architectural Committee have the right to issue fines as deemed necessary. Homeowners will be advised of the violation and be given ample time to rectify the issue. Violations not attended to can be re-issued to the homeowner monthly with no cap on the number of fines possible for an ignored violation. Violations "not able to be fixed due to weather" do not exempt a homeowner from re-occuring fines.
